Understanding Real Estate Agent Compensation Practices: A Response to Recent Real Estate Lawsuit

Real estate agent compensation practices are currently under scrutiny, impacting buyers and sellers alike. Recent legal challenges have questioned the traditional model where sellers compensate buyers’ agents, raising concerns about fairness and transparency.

The Firm’s Stance

RE/MAX Executive strongly advocates for offering compensation to buyer’s agents through the Multiple Listing Service (MLS), ensuring comprehensive representation for all parties involved. Despite legal challenges, the firm believes this practice fosters healthy competition and benefits consumers.

Implications for Buyers

In states like North and South Carolina, buyer agencies have been standard to ensure representation. However, changes in compensation may require buyers to adapt, such as through upfront retainer fees or leveraging incentives from listings. This particularly affects first-time buyers, Veterans (VA buyers), and those with Federal Housing Administration (FHA) loans who rely heavily on agent support and might not have extra funds to pay their buyer agent for representation.

The settlement is finalized and while there have certainly been attention-grabbing headlines, I think it’s important for Massachusetts homeowners and want-to-be homeowners to understand the 4 key points that came out of the settlement:

  1. Buyers and Buyer’s Agents will now need to have written agreements (similar to how homeowners and list agents have written agreements).
  2. Offers of compensation are to be moved off of the MLS (Compensation will now need to be negotiated at the point of offer).
  3. This settlement releases the National Association of Realtors from liability.
  4. The National Association of Realtors will pay $418 million over 4 years.

My takeaway: Change is inevitable and it will take some time to get used to, but I ultimately believe this agreement will benefit everyone. Homeowners and prospective buyers deserve transparency, and similarly, Realtors deserve recognition and fair compensation for their work.

One encouraging sign is the slight improvement in the housing supply. Over the course of a month, the number of available homes increased from 2,727 to 3,000. This uptick provides more options for buyers and helps alleviate supply constraints.

Mint Hill Golf Community in Town of Mint Hill

Olde Sycamore is a residential community located in southeast Charlotte, North Carolina, United States. The community is situated around a golf course and features a mix of single-family homes, townhomes, and patio homes.  Olde Sycamore is great for anyone wanting top community amenities and enjoys golf.

Golf Plantation- Mint Hill

The Olde Sycamore Golf Plantation is an 18-hole semi-private golf course designed by Tom Jackson, which offers a challenging and enjoyable golfing experience for players of all skill levels. The golf course also features a practice range, putting green, and a fully stocked pro shop.

In addition to golfing, residents of Olde Sycamore have access to several amenities, including a clubhouse, swimming pool, tennis courts, playground, and walking trails. The community also has a homeowners association (HOA) that manages common areas and ensures that community standards are upheld.

Mint Hill – Why live here?

TAXES YOU NEED TO KEEP IN MIND

Knowing anything is power, I wanted to provide you with this information on the Mecklenburg taxes. I wanted to communicate this to my Realtor partners because that is what my management team sent me.

Since Mecklenburg County is mandated to update the assessed values of all properties every four years, they just published their new tax rates. To check the new tax rate for any purchase transactions in Mecklenburg County, you must pull up the tax bill using the link below.

Below is a screenshot of where this can be found.

 

 

 

 

 

 

 

 

 

 

You then need to figure out which municipality it’s in.  For example, the screen shot below is in Charlotte so the new tax rate is .7335.  The new assessed value for this property is $1,093,500 so to calculate the taxes, you take $1,093,500, multiply by .007335 to get the annual amount, and then divide by 12 to get the monthly amount that you should put into PCL.  So the monthly taxes for this property will be $668.40.  You should NOT be looking at the prior year’s tax bill to obtain the property taxes since the new assessed values and tax rates are now out.

South Charlotte Neighborhoods

 SOUTH CHARLOTTE NEIGHBORHOODS

Bordering South Carolina, the South Charlotte area is a bustling suburb for those wanting “newer” homes, mostly built after 1990, top-ranked schools, and plenty of Targets and shopping centers nearby.   With the new Ballantyne area booming with Go Ballantyne and live music at the AMP, this once snubbed area of “Ballantyne” which seemed so far away, is now feeling a lot closer to “things” for the active person.  South Charlotte has many pockets which can be confusing to someone new to our area.

Blakeney, South Charlotte, Waverly, Ballantyne

These areas are bordered by the town of Matthews and Pineville, which will feel just a little more “small” town with cute historic downtowns to explore.

South Charlotte Trails

Four Mile Greenway and shopping

Let’s get back to South Charlotte!  Within this area, you will find the 4-mile creek greenway.  A true destination for someone seeking a beautiful nature trail in the middle of the “suburb.”  You can visit Trader Joe’s, Starbucks, and other small businesses before or after your walk!  Bordering this special gem is a community called TOUCHSTONE VILLAGE; tucked behind Touchstone Village is a 54-home community called Wilshire.  These homes were built in the early 1990s and developed by Crosland.  The Touchstone Village homes will have low ceilings, smaller rooms, and popcorn ceilings–however, most have stunning .50-acre lots!

 

 

 

 

 

Living in south charlotte

Four Mile Greenway

Either way, the bonus of living near here is the quick access to the greenway, 485, 51, South Park, and Ballantyne.  It is a true gem for someone who doesn’t want to be FAR OUT from Uptown Charlotte and keep their social calendar open to options to get to so many places in “15 minutes easily.”

PROPERTY TAX – Mecklenburg County Homeowners Hit PLAY before you PAY!!

Whatever we purchase, either online or offline; whether it’s tangible or not, let’s admit it there’s always a value added tax on it. Sometimes we might not notice but we ALWAYS PAY TAXES. And today we’re not only talking about Taxes, we’re discussing a reassessment year that happens every 4-8 years.

NOTE:  They will send you the new value in the mail, but then they “normally” adjust the tax rate for the value in June.  In past years, everyone panics, and then the county sets the new tax rate and that % is applied to your value.

Property Tax is  a real estate ad-valorem tax, which can be considered a regressive tax, commonly calculated by a local government. It is based on the value of the property which can be real estate or – in many jurisdictions – also tangible personal property. Under the North Carolina Law it requires at least (8) eight years to conduct a property reassessment to determine it’s market value. On the other hand, Mecklenburg County has advanced their cycle to conduct the procedure every four (4) years.

Here are three (3) different criteria to consider:

  •  THE CHARACTERISTICS MATCH THEIR FILE

– For example: you permanently added a screen porch and spent about $30,000 – 80,000 on it. You’ll be receiving a notification from Mecklenburg County informing you that there will be an assessor visiting you.

Every detail, changes, upgrades will be assessed by them.

  • COMPARABLE SALES

– are comparable properties in a specific area that you’re looking to buy or sell in. They are used to determine the home value by comparing it to similar properties sold in the same neighborhood.  You will contact your local trusted real estate agent and they should be able to assist you. If you don’t have one, then hopefully you will think to contact me as your local Charlotte real estate agent!

  • ANY KNOWN IMPROVEMENTS

– Any improvement or changes you put to the house that can be taxed on.

For instance, you noticed that there might be some errors on the declared tax, there are also options for you to do.

  • Reach out to them and do an informal review
  • Formal review , go in front of them to argue your case
